General conditions of use
These General Conditions are valid from 24 April 2008 onwards.
The Lyria website, tgv-lyria.com, operated by Lyria SAS, (RCS1 Paris B 428 678 627) has been duly declared to the CNIL2 under number 1049318.
Article 1. Definitions and scope of application
1.1. Definitions
With a concern for readability, the following definitions are presented in alphabetical order.
“Administrator” shall designate the person responsible for managing the Website on behalf of Lyria SAS.
“Partners” shall designate any Lyria SAS supplier. The term “Partner” shall notably include SNCF and CFF as suppliers of train tickets and as parties responsible for the corresponding rail services.
“Product” shall designate the train tickets sold by the Partners in addition to other services sold by non-rail partners.
“You” or “the User” shall designate any person using the “Proceed with the order” space, in order to reserve, order and/or purchase any rail product offered by Voyages-sncf.com, cff.com and/or tgv-europe.com or any other non-rail product.
1.2.Scope of application
These general conditions of use (hereafter the “General Conditions”) apply to all services offered on the website www.tgv-lyria.com (the “Website”), until the User is redirected towards the Partner sites.
Lyria SAS reserves the right to modify these General Conditions at any time without prior notice.
Article 2. Use of the www.tgv-lyria.com website
In particular, the Website serves to inform TGV Lyria Users and facilitate User access when searching for products, so as to allow them subsequently to make the appropriate reservations or any other transaction directly with the Partners.
A fraudulent use of the Website or a use which contravenes these General Conditions may lead to access to the services offered on this Website by Lyria SAS being denied at any time.
Product searches and submitting orders
If you wish, the Website can make it easier for you to search for the times that trains leave and arrive at the cities listed on it, and find available seating, on the dates and at the times you have specified.
Once you have entered where you will collect your tickets (France, Switzerland or other countries), the city of departure and of arrival, the dates and times of departure and return, the class (1st or 2nd class), the number and type of passengers, by clicking on “Proceed with the order”, you will be immediately redirected to the website of the corresponding Partner (SNCF or CFF), depending on whether you have chosen to collect your tickets in France, Switzerland or other countries. From this point onwards, you may consult timetables and submit orders for tickets on the Partner Websites.
The conditions for submitting orders, payment, delivery, amendment or cancellation shall be the sole liability of the Partners, since orders are directly submitted to their websites.
Lyria SAS does not assume any liability for the Products ordered and/or purchased on Partner Websites or for the corresponding rail and non-rail services.
Complaints regarding the quality of service on TGV Lyria trains by Partners or their service providers may be submitted to Lyria SAS by sending an e-mail to info@lyria.biz or by post to Lyria SAS, 25 rue Titon, 75011 Paris (France).
Lyria SAS shall then undertake to submit these complaints to the Supplier and/or service provider in question. Lyria SAS shall not in any event be liable however for the poor execution of the service provided by the Partners or for any accidents or injuries of any nature occurring with regard to it.
Article 3. Intellectual property
Lyria SAS is the owner of all intellectual property rights relating to the Website.
Access to the Website shall not confer any right on Users with regard to the intellectual property rights relating to the Website, which shall remain the exclusive property of Lyria SAS.
Elements accessible on the Website, notably in the form of text, photographs, images, icons, maps, sounds, videos, software, databases and data shall also be protected by intellectual and industrial property rights and other exclusive rights held by Lyria SAS.
With the exception of explicit provisions indicated in this document, the User may not, in any event, reproduce, represent, modify, transmit, publish or adapt in any medium, by any means, or use in any manner, all or part of the Website without the prior written authorisation of Lyria SAS. Notably, but not exclusively, practices such as scraping or the use of robots for the purposes of extraction or reproduction of any element of the Website are prohibited.
Article 4. Liability and guarantees for the use of the Website
Lyria SAS does not guarantee that the Website shall be free from anomalies, errors or bugs, nor that these may be corrected, nor that the Website shall operate without interruptions or breakdowns, nor that it will be compatible with particular equipment or a particular configuration, other than that expressly endorsed by Lyria SAS.
Lyria SAS shall in no event be liable for malfunctions attributable to third-party software, regardless of whether or not such software is incorporated into the Website or provided with it.
Lyria SAS shall in no event be liable for any type of damage, whether foreseeable or not, arising from the use or total or partial impossible use the Website. Lastly, since Lyria SAS cannot control all of the websites, notably those of Partners, to which it refers Users via hypertext links, and which only exist to facilitate User searches, it shall in no event be liable for their content.
The User declares being familiar with the characteristics and limits of the Internet, in particular with its technical performance, response times for consultations, queries or data transfer and with the risks linked to communications security.
Article 5. Protection of personal data
The Website tgv-lyria.com, operated by Lyria SAS, has been duly declared to the CNIL under number: 1049318.
The personal data of Internet users is protected pursuant to the Confidentiality Charter which Lyria SAS makes available to Users on a permanent basis and which may be accessed by a hypertext link at the foot of every page of the Website.
Article 6. Applicable law
The general conditions are subject to French law. In the absence of an amicable settlement, any disputes relating to their interpretation and/or execution shall be referred to the French courts.
Any claim relating to the quality of the products and services supplied by the service providers shall be the sole liability of these parties and only they shall be subject to legal proceedings.
Article 7. Final provisions
The fact that, at any given point, Lyria SAS does not make use of one of the provisions of these General Conditions, shall not be interpreted as a waiver by Lyria SAS of the right to cite these at a later date.
In the event that one of the provisions of these General Conditions is declared to be null and void, it shall be considered to be invalid without affecting the validity of the other provisions, except where the provision declared null and void was essential and decisive.
It is hereby specified that Lyria SAS and its Partners are distinct companies with their own autonomy and independence. None of the provisions of this instrument may be interpreted as creating a de facto company or joint venture between Lyria SAS and its Partners.

The information which you communicate to the Website www.tgv-lyria.com (the “Website” or the “Lyria SAS Website”) allows your requests to be processed. Pursuant to Article 32 of the Loi Informatique et Libertés [Information Technology and Freedom Law] of 6 January 1978, information essential to Lyria SAS for processing your requests is indicated by an asterisk on the pages of the Website. The other information requested, for which answers are optional, is intended to provide better knowledge of users, and thus to improve the services offered to them while ensuring security.
Pursuant to the Information Technology and Freedom Law, we suggest that Internet users who no longer wish to receive messages unsubscribe by way of a simple mouse click.
Since the tgv-lyria.com website is an information website, purchases of rail products are made directly on partner websites, namely voyages-sncf.com, tgv-europe.com or cff.com, in the same way that purchases of non-rail products are made directly on the websites of non-rail partners. In this way, the latter sites may send you information by post or e-mail which provides greater knowledge and ease of use of their respective websites as well as offers of non-rail products. Lyria SAS is in no way liable for the processing of your data on these websites. In addition, if you wish to object to the processing of your personal data on these websites, you are responsible for exercising this right directly with the party responsible for the websites in question.

Notices from the Lyria SAS Website
Users may receive notices from the Website in the following cases:
• Submission of client and/or agency complaints, questions/suggestions: Lyria will respond by e-mail to the Internet user.
• E.mailing : notably with regard to games and competitions, the Internet user may be offered additional electronic communication, via the Website, in the form of commercial e-mails. These will make specific commercial offers proposed by the partners of Lyria SAS to Internet users who have voluntarily signed up for these, and have hence given their prior authorisation.
Protection of information provided
With a concern to provide evidence of trust to Internet Users connecting to its Website, Lyria SAS is careful to protect the information which it gathers. In order to guarantee this protection, it has implemented a security programme for data stored in its systems.
Partner Sites
While searching for a product, the user may access partner sites directly, notably Voyages-sncf.com, cff.com or tgv-europe.com by way of a simple mouse click. These sites are not governed by these provisions for personal data protection. The user is thus invited to examine the rules governing the use and disclosure of the information which they have communicated to these websites.
