ARTICLE 1: ORGANISER
Lyria, a simplified joint stock company, registered on the Paris Companies’ Register under number B 428 678 627, with its registered office at 25 rue de Titon, 75011 Paris, France (hereinafter referred to as the ‘Organiser’), is holding a prize draw competition in France and Switzerland with no purchase necessary.
ARTICLE 2: ENTRY AND VALIDITY PERIOD
You can take part in the competition using the TGV Lyria on-board Wi-Fi portal:

The prize draw period runs from 00.00 am on 01/06/2024 to 11.59 pm on 30/09/2024 (Paris time), using the connection date and time as the basis.
ARTICLE 3: TERMS OF PARTICIPATION
Participation in the competition is open to any individual who is aged 18 or above at the time of entry, is criminally responsible, is resident in France or Switzerland, and has internet access and an email address. This excludes any employees of the Organiser who were involved in developing the questionnaire and their close family members (parents, siblings, or any other individual resident in the same household), and those of the companies involved in developing the questionnaire and their close family members (parents, siblings, or any other individual resident in the same household).
Entry is limited to one person per household (same surname, same address).
It is expressly noted that entry in the competition is not conditional on any obligation to make a purchase.
ARTICLE 4: TERMS OF THE COMPETITION
To enter the competition, the Participant must:
- Have their own email address.
- Be in possession of a TGV Lyria ticket valid for the trip made at the time of entering the competition.
To take part in the competition, each individual must connect to the TGV Lyria on-board WiFi portal, provide the requested information, and read and accept the terms of use for the WiFi portal. Participants can only take part once and undertake to comply with the terms of use when entering the competition.
ARTICLE 5: ANNOUNCEMENT OF THE WINNERS
The winner will be drawn from all email addresses provided where the terms of participation have been met. The prize draw will take place and will be performed by TGV Lyria teams at the company headquarters at 25 rue de Titon, 75011 Paris, France.
ARTICLE 6: RESPECTING THE INTEGRITY OF THE COMPETITION
Participation in this competition is subject to accepting and complying unreservedly with the provisions set out in these rules. Participants are prohibited from employing, or seeking to employ, any entry method that does not strictly comply with the principles of the prize draw as well as these rules. Furthermore, the Organiser reserves the right to disqualify any participants that interfere with the proceedings of the competition or breach the official prize draw rules. The Organiser reserves the right to take legal action against anyone attempting to cheat or to interfere with the orderly running of this prize draw.
The Organiser reserves the right to perform any necessary checks to ensure compliance with these rules, namely, to eliminate any participant who has committed any abuse or any fraud attempt, without this entailing any obligation to perform systematic checks on all entries but allowing the Organiser to potentially limit these checks to winning entries. The Organiser may decide to cancel the prize draw if it transpires that blatant fraud has taken place, whatever form this may take, in connection with entry in the competition or selection of the winners.
ARTICLE 7: FORCE MAJEURE AND UNPREDICTABILITY
The Organiser cannot be held liable for the postponement, suspension or cancellation of the prize draw if and insofar as this postponement, suspension or cancellation is due to a case of force majeure such as that defined by the Court of Cassation (the French Court of Appeal).
ARTICLE 8: PRIZES
The competition prize is as follows:
A return ticket for two people travelling on a Première train between Paris and Basel, Paris and Zurich, Paris and Lausanne, or Paris and Geneva. The ticket has a value of EUR 756 / CHF 796 CHF and is valid on all trains that offer this travel class, and subject to the number of seats available at the time of booking.
Train times will be confirmed during communication with TGV Lyria.
However, in the event of any problem relating to the prize, the Organiser reserves the right to change and/or replace the prize provided for initially in these rules with an equivalent prize, it being stipulated that the decision to change and/or replace and the choice of equivalent prize is at the sole discretion of the Organiser.
The Organiser declines any responsibility in the event of any incident that might arise from the use or enjoyment of the prize won.
ARTICLE 9: PRIZE HANDOVER
The winners will be informed of their prize by email. If winners’ details are incomplete, illegible, incorrect or unusable, they will forfeit their prize. It is also the responsibility of the Participant to ensure that the email does not end up in their Junk folder.
On receipt of this message, the winners must provide the information necessary to allow the Organiser to award the prize.
If winners fail to confirm their details, they will forfeit their prize. Prizes cannot be exchanged, on request from the winners, for cash or any other compensation, and nor can they be replaced by a prize of equivalent value.
Shipment of the prizes, while undertaken in the best interests of the winners, will take place at the recipients’ risk.
ARTICLE 10: COMMUNICATION
The Organiser will not respond to any requests for information (whatever form these may take – primarily written, over the phone and verbally) concerning the interpretation or application of these rules, the mechanisms or terms of the prize draw or the list of winners.
ARTICLE 11: APPLICABLE LAW
These rules are subject to French law.
ARTICLE 12: CONTENT PRODUCTION
The winners authorise TGV Lyria to share any content that they may publish on their social media accounts in connection with the prize draw on its own social media accounts.
ARTICLE 13: DATA PROCESSING AND FREEDOM OF INFORMATION
To take part in the competition, participants must provide some personal details. This information will be collected, stored and processed electronically in accordance with Law no. 78-17 of 6 January 1978 regarding data processing, files and freedoms, and amended by Law no. 2004-801 of 6 August 2004. This processing is only intended for the Organiser. This information will be stored in France for the duration of these operations and destroyed at the end of the same.
Participants expressly agree to the collection and processing of this information for the purposes of the prize draw.
The information collected by TGV Lyria, excluding information provided in forms that participants have consented to, will not be used for commercial purposes. Without this consent, this information will not be used by TGV Lyria, except to contact the winners in connection with the prize draw, and nor will it be sold on to third-party companies.
In accordance with the European Union’s General Data Protection Regulation, you may contact the DPO (Data Protection Officer) on [email protected] to exercise your rights of access, rectification and erasure in relation to your personal data and processing of the same. ARTICLE 14: LIABILITY
The Organiser cannot be held liable for any malfunctions that cause errors in the administration, security, fairness, integrity or management of the prize draw. Notably, the Organiser cannot be held responsible for any errors, omissions, interruptions or the loss of any data for this reason.
Furthermore, the Organiser waives any responsibility in the event of a failure of the ‘internet’ or WiFi network preventing entry and/or the proper progress of the questionnaire, due namely to external malicious acts or force majeure.
The Organiser waives any responsibility in the event of any software or hardware technical failure or anomaly (virus, bug, etc.) occurring on the Participant’s system and IT equipment or the information stored there. Under no circumstances can the Organiser be held responsible for any consequences that may arise from this for the Participant’s personal, professional or commercial activities.
